Notice of Creditors’ meeting in the matter of El Baba PTE.LTD

IN THE MATTER OF

INSOLVENCY, RESTRUCTURING AND DISSOLUTION ACT 2018 (ACT 40 OF 2018)

AND

IN THE MATTER OF

EL BABA PTE. LTD. (IN PROVISIONAL LIQUIDATION) (UEN NO. 201736808E)

(the “Company”)

NOTICE IS HEREBY GIVEN pursuant to Section 166 of the Insolvency, Restructuring and Dissolution Act 2018 (Act 40 of 2018) (“IRDA”) that a Meeting of the Creditors of the abovenamed company will be held by electronic means by way of video conference on 15 July 2022 at 3:30 p.m. (Singapore time) for the following purposes:

  1. To receive a full statement of the Company’s affairs together with a list of its creditors and the estimated amount of their claims;
  2. To nominate Luke Anthony Furler and Ellyn Tan Huixian of Quantuma (Singapore) Pte Limited c/o 8 Eu Tong Sen Street, #18-81, The Central, Singapore 059818, jointly and severally, as Liquidators for the purpose of winding up the affairs and distributing the assets of the Company.
  3. To resolve that the Liquidators be at liberty to open, maintain, and operate any bank accounts or an account for monies received by them as Liquidators of the Company, with such bank as the liquidator deems fit;
  4. To appoint a Committee of Inspection of not more than 5 members, if thought fit;
  5. Should a Committee of Inspection be formed, to approve the Liquidators’ power pursuant to Section 144(1) of the IRDA;
  6. Any other business.

Note:

Particulars of the claims of any creditors wishing to attend and vote at this meeting must be lodged by way of email to: Bradley.windley@quantuma.com not less than 48 hours before the time affixed for the holding of the Meeting. Secured creditors (unless they surrender their security) must give particulars, the date it was received and its value if they wish to vote at the meeting.

A creditor may appoint a proxy to attend and vote at the meeting. Forms of general and/or special proxy must be duly completed and lodged by way of email to: Bradley.windley@quantuma.com not less than 48 hours before the time affixed for the holding of the Meeting.
